He wanted a second trial. 32-year-old Jermaine A. Drake is serving a 55-year prison term in the 2004 fatal shooting of Christopher Masiongale – who was just 18. The Muncie man says his attorneys should have pursued a change of venue and suppressed testimony in his first trial. The court of appeals says Drake had “failed to meet his burden” to warrant a new trial.
