A rural Modoc man — sentenced to 55 years in prison for the beating death of his wife – wants a new trial. A Randolph Circuit Court jury found Robert M. Foy Jr. guilty of the crime in 2009. Foy claims that attorneys, who represented him at trial, and in a later appeal, provided “ineffective assistance.” A hearing on the petition has not yet been scheduled.
